Amid\n recent protests in Hong Kong, a high court has ruled that a last-minute\n revival of laws banning face masks was unconstitutional by the \ngovernment.<\/h2>\n\n\n\n

The Hong Kong high court has found the resuscitated ban on face masks<\/a> was \u201cincompatible with the Basic Law\u201d<\/em> of Hong Kong, a constitution that has been present since HK\u2019s ownership returned to China in 1997.<\/p>\n\n\n\n

\u201cThe restrictions it imposes on fundamental rights \u2026 go further \nthan is reasonably necessary \u2026 and therefore fail to meet the \nproportionality test,\u201d<\/em> the court said<\/a>, according to Al Jazeera.<\/em><\/p>\n\n\n\n

The ban was originally reinstated in October after, for the first \ntime in 50 years, the unelected pro-China party invoked colonial-era \nlegislation (the Emergency Regulations Ordinance). Residents of Hong \nKong are currently protesting against the Chinese rule and demanding \ndemocratic rights as well as several investigations into police \nbrutality on the back of the protests. In particular, protestors want \nthe government to allow free elections for the city of 7.5 million \npeople.<\/p>\n\n\n\n

The protests have so far involved thousands of Hong Kong residents, \nand local police forces have geared up heavy and resorted to throwing \ntear gas among other action. It\u2019s no surprise protesters have been using\n face masks, helmets and goggles, both in a bid to hide their individual\n identities and in order to avoid the gas.<\/p>\n\n\n\n

The ban makes it illegal to wear a mask at a sanctioned or \nunsanctioned rally, and if caught any of the protestors could face up to\n a year in prison. The High Court has now ruled<\/a> the ban as unconstitutional but further action has not yet been taken.<\/p>\n\n\n\n
